Kovai Textiles Inc., doing business as “EverNest” (“EverNest”, “we”, “us”, or “our”), respects your privacy and is committed to protecting your personal information when you visit our website, join our waitlist or purchase our products in Canada.
By using our website, joining our waitlist or otherwise sharing personal information with us, you agree that we may collect, use and disclose your information as described in this Privacy Policy.
1. Who we are and where this Policy applies
This Privacy Policy explains how EverNest collects, uses, discloses and protects your personal information when you interact with us online. It applies to:
- Our website and online store hosted on Shopify
- Our waitlist and pre‑launch sign‑up forms
- Our email, SMS or similar direct marketing where we control the content and collection of your information
- Any other online sales channels or services that link to this Privacy Policy
We currently sell only within Canada and this Policy is intended for individuals located in Canada.

The personal information we collect depends on how you interact with us. “Personal information” means information about an identifiable individual.
a) Information you provide to us
We may collect:
- Waitlist details: First name, last name, email address and how old your child is when you join our waitlist or sign up for updates.
- Account information: Name, email address, password and any profile or preference information you add to your account.
- Order and shipping information: Name, billing and shipping addresses, email, phone number, products purchased, order history, returns and exchanges.
- Payment information: Payment card and billing details are collected and processed securely by our payment processor (such as Shop Pay / Shopify Payments). We do not store full card numbers or security codes on our own systems.
- Communications: Information you provide when you contact us (for example by email), including your questions, comments and any other details you choose to share.
- User‑generated content (UGC): Reviews, ratings, comments, photos, videos, social media handles and other content you submit on our site or on social media where you tag or mention EverNest or use our brand hashtags. This may include content submitted through our website using a third‑party reviews tool (such as Judge.me) or through our social media channels
b) Information collected automatically
When you visit our website or use our online services, we automatically collect certain information using cookies and similar technologies, such as:
- IP address, device identifiers and browser type
- Operating system and device settings
- Pages viewed, links clicked, time and date of visits and referring URLs
- Approximate location based on your IP address
This information is mainly used for site operation, security, analytics and marketing, as described in Section 4.
c) Information from our partners

- Shopify (our ecommerce platform), related to your orders and use of our store
- Email and marketing providers (such as Brevo, Zoho), about your subscriptions and interaction with our emails
- Analytics and advertising partners (such as Google Analytics and Meta), in aggregated or pseudonymous form, about website traffic and ad performance
3. How we use your personal information
We use personal information for the following purposes:
a) To operate our website and services
- Provide, operate and maintain our website, online store and waitlist
- Enable you to browse products, use shopping features and access your account
b) To manage the waitlist and launch communications
- Manage our waitlist and pre‑launch activities, including eligibility for launch offers (for example, complimentary products for early customers)
- Send you updates about our launch, product availability, promotions and EverNest news when you sign up and give consent
c) To process orders and provide customer support
- Process and fulfill your orders, including payment, shipping, returns and exchanges
- Contact you about your orders, deliveries, returns, account issues and customer service inquiries
d) For marketing, personalization and referrals
- Send you newsletters, promotions and special offers, where you have opted in or where permitted by law
- Segment and personalize communications (for example, by your child’s age, order history or preferences)
- Operate referral or rewards programs where you invite friends; if you provide another person’s contact details, you confirm you have their permission to do so

e) For analytics and advertising
- Understand how visitors use our website and improve our design, content and user experience

- Collect, moderate and display reviews, ratings and other UGC on our website and marketing channels, using our own tools and trusted third‑party providers (such as Judge.me).
- Show limited identifying details with reviews, such as first name and general location, where you choose to provide them.
We use personal information only for the purposes described in this Policy or for closely related purposes that would be reasonably expected in the circumstances, unless we obtain your consent for a different use or are otherwise permitted or required by law.
4. Cookies and similar technologies
Our website uses cookies and similar technologies to:

- Ecommerce and payments: Shopify (hosting and store platform) and payment processors such as Shop Pay / Shopify Payments
- Logistics and shipping: Third‑party logistics and shipping providers (including aggregators and carriers) that deliver your orders
- Email and marketing: Email and marketing platforms (such as Brevo) used to send newsletters, waitlist messages and other communications
- Reviews and user‑generated content: Reviews and UGC tools (such as Judge.me) used to collect, request, moderate and display product reviews, ratings and other content that you choose to share with us. These tools are used only for our store and do not give other merchants access to your identifiable review information.
- Analytics and advertising: Providers such as Google Analytics and Meta that support website analytics and advertising
- Professional and support services: Accountants, legal advisors and cloud‑based productivity tools used for internal administration and record‑keeping
These providers receive only the personal information they need to perform their services and are expected to protect it and use it only for those purposes.
b) Business transactions and legal requirements
We may disclose personal information:
- In connection with a proposed or completed merger, acquisition, financing, sale of assets or similar business transaction, where personal information may be transferred as part of the transaction

Please be aware that user‑generated content may be visible to others and may include personal information (for example, your name, social media handle or image). If you would like us to remove specific content that you have shared or that we have reposted, you can contact us and we will do our best to accommodate your request where reasonable and not in conflict with our legal rights or obligations.
